To RPC’s clients and friends

Thanks to our clients and associates, 2019 was another successful year for RPC. We opened over two dozen new healthcare litigation projects and thirteen new CON projects. We welcomed nine law firms as new clients for these cases. From discovery requests through trial testimony, we helped litigators understand healthcare financial and operational data. Here are some of RPC’s notable accomplishments in 2019:

Healthcare Litigation

  • We provided expert analysis for health plans, health care providers, and qui tam relators in Texas, New Mexico, Utah, Washington, and Florida.
  • We helped health plans and health care providers to determine usual, customary, and reasonable charges for out-of-network physician and hospital services.
  • We analyzed adequacy of payment by health plans relative to the federal “Greater of Three” rule and relative to state laws.
  • We helped freestanding emergency departments in Texas adjust their chargemasters to comply with new Texas legislation.
  • We helped a firm specializing in review of air ambulance bills to successfully defend against allegations of disparagement by an air ambulance company.
  • We helped a contractor to resolve business interruption damage claims by a hospital due to aa fire.

Certificate of Need

  • RPC continued its national CON practice launched in 1980. We worked on matters in Tennessee, North Carolina, Florida, Mississippi, Alabama, Georgia, West Virginia, and the District of Columbia.
  • We helped an opioid treatment program in Tennessee obtain a CON for a new clinic, expanding patient access and the client’s footprint in the state.
  • We helped a hospital system in North Carolina obtain several CONs to expand its acute care, endovascular, rehabilitation, and surgical services. We helped prepare the applications and provided expert testimony in the CON appeals process.
  • We helped a national hospice client obtain a CON for an additional service area in Florida.
  • We helped a national rehabilitation hospital client obtain a new hospital and a bed expansion.
  • We helped a continuing care retirement community in Washington, DC obtain a CON to adjust its bed complement to better meet the needs of residents.
  • We provided clients in West Virginia, the District of Columbia, Mississippi, and Tennessee with market analysis and guidance on the feasibility of potential CON projects.
