With the passage of Senate Bill 164 earlier this year, South Carolina removed certificate of need (CON) requirements for Ambulatory Surgery Centers (ASCs). New ASCs now only require state construction plan and specification approval before beginning construction and licensure before operation. Most ASCs also need Medicare certification. This legislation is an opportunity for physician groups, owners of existing ASCs, and other health facility developers to open a new ASC or expand an existing facility without the regulatory cost, delay, or uncertainty of the CON program.
